1. General Definitions

Platform: The website, mobile app and subdomains owned by ProstEvents, acting as a technological intermediary for ticket sales.

Organizer: The individual or legal entity that creates, promotes and runs the event, using the Platform to manage and sell tickets.

Buyer/Participant: The individual or legal entity that purchases tickets for events listed on the Platform.

Ticket: The digital or physical voucher generated by the Platform that grants access to the corresponding event.

2. Platform Role (Scope of Service)

ProstEvents is solely a technological intermediation platform.

We provide the software and gateway so Organizers can sell tickets and Buyers can purchase them.

We do not organize, produce, sponsor or control the events listed on the Platform.

We are not responsible for schedule changes, venue changes, cancellations, quality, security or any occurrence during the event itself. This responsibility belongs entirely to the Organizer.

3. Registration and Account Security

To buy or create events, Users must provide true, accurate and up-to-date information.

Users are solely responsible for keeping their login credentials (email and password) confidential.

Suspicious activity or unauthorized account use must be reported to the Platform immediately.

Accounts created by minors must comply with local rules on legal capacity and parental/guardian consent.

4. For Buyers (Ticket Purchases and Payments)

Prices and Fees: Ticket prices are defined by the Organizer. The Platform may charge a service fee per processed ticket, clearly displayed before checkout.

Payment Processing: Payments are processed by partner companies (payment gateways). The Platform does not store sensitive credit card data.

Ticket Delivery: After payment confirmation, the digital ticket (QR code/voucher) is sent to the registered email and remains available in the user profile. Buyers are responsible for presenting the ticket at event entry.

5. Cancellation, Refund and Return Policy

Refund Responsibility: The Organizer is solely legally responsible for refunds in cases of withdrawal, postponement or event cancellation.

Legal Deadline: According to applicable consumer protection rules, Buyers may withdraw within 7 (seven) calendar days from purchase, provided this does not exceed 48 hours before event start.

Service Fees: In case of buyer withdrawal, the Platform service fee may be non-refundable, since the intermediation service has already been provided at purchase time.

Cancelled Events: If the Organizer cancels the event, they must instruct the Platform to process refunds and remain responsible for providing the necessary funds.

6. For Organizers (Event Creation and Management)

By publishing an event, the Organizer guarantees that:

The event is real, lawful and has all permits, licenses and authorizations required by local authorities.

Provided information (date, location, lineup, age policy) is accurate and truthful.

Payouts: The Platform will transfer net sales amounts (after commission and processing fees) within [X] days after successful event completion to help protect Buyers against fraud.

Organizer Cancellations: If the Organizer cancels or substantially changes the event, they assume full responsibility to reimburse Buyers. The Platform reserves the right to withhold Organizer balances to cover chargebacks and refunds.

7. Intellectual Property and Prohibited Use

All design, source code, brands, logos and Platform content are exclusively owned by ProstEvents.

Using robots, scrapers or automated tools (bots) for fraudulent mass ticket buying (scalping) is strictly prohibited.

Users may not publish offensive, illegal, discriminatory content or content that infringes copyright on event pages.

8. Limitation of Liability

The Platform is provided "as is", with no guarantee that the system will be 100% free of temporary interruptions, bugs or network instability.

Under no circumstances shall ProstEvents be liable for lost profits, indirect, incidental or punitive damages arising from platform use or participation in listed events.

9. Privacy and Data Protection

Collection and processing of users' personal data (such as name, email and payment data) follow our Privacy Policy and applicable data protection laws (such as LGPD or GDPR, depending on market).

10. Changes to Terms

The Platform reserves the right to modify these Terms at any time. Significant changes will be notified by email or site notice. Continued use after changes constitutes acceptance of the updated Terms.

11. Governing Law and Venue
